DES MOINES, Iowa - The state's new collective bargaining law that restricts union bargaining rights is being considered by the Iowa Supreme Court.

Two large state employee unions say the law is unconstitutional.

AFSCME, the American Federation of State, County and Municipal Employees is the largest public employees' union in Iowa.  They're challenging the part of the law that requires at least 30 percent of union membership to be public safety employees, like police and fire, before the union will be allowed to bargain for more than just wages.  AFSCME questions the 30-percent figure.

Supreme Court Justice David Wiggins appears to agree, commenting in the courtroom.

"It seems like they picked the 30-percent to exclude AFSCME somehow."  Wiggins said.

The other challenge to Iowa's new law is from the Iowa State Education Association.

Lower courts threw out challenges to the Iowa law by both unions.
